IF CUSTOMER IS AGREEING TO THIS AGREEMENT ON BEHALF OF OR FOR THE BENEFIT OF ITS EMPLOYER, THEN CUSTOMER REPRESENTS AND WARRANTS THAT IT HAS THE NECESSARY AUTHORITY TO AGREE TO THIS AGREEMENT ON ITS EMPLOYER’S BEHALF.

● CANCEL: IF CUSTOMER DOES NOT WANT TO AGREE TO THIS AGREEMENT CLICK “REJECT,” BUT THEN CUSTOMER CANNOT USE THE SERVICE.

This agreement is between Trcked Up, a Texas entity (referred to as 'Trcked Up' or 'Company') also dba mojoPOS and RushTxt,, and the customer agreeing to these terms ('Customer'). Trcked Up may operate as either a limited liability company or corporation under Texas law.

1. SOFTWARE-AS-A-SERVICE

This agreement provides Customer access to and usage of an Internet-based software service as specified on an order and further outlined at: www.mojopos.com (Service).

5. AUTO RENEWAL AND CANCELLATION OF SERVICE

All mojoPOS subscriptions are billed on a recurring basis in arrears and will automatically renew at the end of each billing cycle unless cancelled at least one (1) business day prior to the renewal date. Customers may cancel their subscription at any time through the secure mojoPOS Portal. Cancellation is a one-click process and must be initiated by the account holder using their login credentials. For security reasons, cancellations will not be accepted via phone, email, or through third parties.

It is the sole responsibility of the Customer to monitor their subscription status and ensure timely cancellation to avoid unwanted charges. Once cancelled, service will remain active through the end of the current billing period, after which no further charges will apply. mojoPOS does not issue refunds or credits for partial months, unused time, or mid-cycle cancellations. Trcked Up may disclose Customer Data or other information relating to the Customer if required to do so by law, regulation, subpoena, court order, or other legal process. Unless prohibited by law or court order, Trcked Up will provide Customer with prompt notice of any such request to allow Customer the opportunity to seek a protective order or other appropriate remedy. Trcked Up shall not be liable for any disclosure made in good faith in compliance with applicable legal obligations.

14. GOVERNING LAW AND ARBITRATION

i. Binding Arbitration.
 Any dispute, controversy, or claim arising out of or relating to this agreement or the breach thereof shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Harris County, Texas. This arbitration agreement shall be governed by the Federal Arbitration Act (FAA), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

The parties agree that arbitration shall be the sole and exclusive forum for resolving such disputes, and each party expressly waives the right to a trial by jury or to participate in any class action or class arbitration. Each party shall bear its own legal fees and costs related to the arbitration.
